Terms of service

These terms govern every order placed at atelierbrim.co.uk. By ordering, you accept them together with our Refund and Returns Policy, Shipping Policy, Privacy Policy and Cookie Policy. They run alongside, and never replace, your statutory rights under the Consumer Rights Act 2015, the Consumer Contracts Regulations 2013 and the Digital Markets, Competition and Consumers Act 2024.

1. Who we are

atelierbrim is the trading name of ZIIEMA, a French micro-entreprise selling to UK consumers as an overseas seller registered with HMRC as a Non-Established Taxable Person (NETP). 2. These terms

We may update these terms to reflect changes to the law or our business; the version in force when you order applies to that order. By ordering you confirm you have read and accepted them. You must be at least 18 and able to enter a binding contract under English law. If you order for an organisation, you confirm you have authority to bind it.

3. Products and pricing

Descriptions, photographs and dimensions are intended to be accurate. The composition of each hat is stated on its product page; small variations in colour, weave and finish are part of the piece, not defects. Prices are in pounds sterling (£), with no further mandatory fees. Any delivery cost is shown in full before you accept payment, and we do not use drip pricing, in line with the Digital Markets, Competition and Consumers Act 2024. Our UK VAT registration is being processed by HMRC; once our UK VAT number is issued, UK VAT will be included in the price shown at checkout for consignments of £135 or less, and the number will be shown in our Legal Notice. For consignments above £135, UK import VAT and duties apply at the border (see our Shipping Policy).

4. Your order

Your order is an offer to buy; a contract forms only when we send an order confirmation email. We may decline or cancel an order for a clear pricing error, an out-of-stock item, an unverifiable or suspected fraudulent payment, or an address we cannot ship to. If we cancel after payment, we refund in full to your original method (regulation 34, Consumer Contracts Regulations 2013). We never pre-tick consent boxes; every choice requires a clear positive action, in line with the DMCC ban on dark patterns.

5. Payment

Payment is processed securely by Shopify Payments (Visa, Mastercard, American Express, Apple Pay, Google Pay, Shop Pay). Card details pass directly from your browser to the processor over an encrypted connection; we never see or store your full card number. Flagged payments may be verified by email before despatch.

6. Delivery, refunds and returns

We ship to the UK using international tracked carriers; UK delivery is free on orders of £45 and over. Under section 28 of the Consumer Rights Act 2015 we deliver within 30 days of the contract unless agreed otherwise; our agreed delivery window is within 15 working days, Monday to Friday. You have a 14-day right to cancel (Consumer Contracts Regulations 2013), a 30-day right to reject faulty goods and a six-month repair or replacement right (Consumer Rights Act 2015), plus a 30-day goodwill window. 7. Reviews

In line with the Digital Markets, Competition and Consumers Act 2024 (in force 6 April 2025), we display reviews only from verified customers, never write, buy or incentivise reviews, do not remove genuine negative reviews, and label any sponsored content (ASA CAP Code section 2). To report a suspect review, email care@atelierbrim.co.uk.

8. Intellectual property

The atelierbrim wordmark, logo, photographs, copy and design are owned by ZIIEMA or used under licence and protected by UK and international copyright, trade-mark and design law. A UKIPO trade-mark application for the atelierbrim wordmark in Class 25 (clothing, headwear) is in progress. You may view, save and print pages for personal, non-commercial use only; you may not copy, scrape or republish content without our written permission. Fair quotation for review or journalism is permitted under section 30 of the Copyright, Designs and Patents Act 1988. IP queries: studio@atelierbrim.co.uk.

9. Acceptable use

You agree not to introduce harmful code, attempt unauthorised access, use bots or scrapers to extract content or prices, disrupt the site, or post unlawful or infringing content. We may suspend access or refer breaches to UK law enforcement.

10. Our liability

Nothing here limits our liability for death or personal injury caused by our negligence, for fraud, or for your statutory consumer rights. Under section 31 of the Consumer Rights Act 2015 we cannot exclude the rights that Act gives you; any clause attempting to do so is unenforceable and the rest of these terms still applies. Otherwise we are responsible for reasonably foreseeable losses caused by our breach, but not for unforeseeable or business losses.

11. Privacy and cookies

We process personal data only as set out in our Privacy Policy (UK GDPR, Data Protection Act 2018, Data (Use and Access) Act 2025) and use cookies only as set out in our Cookie Policy (Privacy and Electronic Communications Regulations 2003). Non-essential cookies are set only after your explicit consent.

12. Force majeure

Neither party is liable for failure or delay caused by events beyond reasonable control (for example pandemic, war, sanctions, cyberattack, carrier or border disruption, utility or supply-chain failure). If such an event lasts more than 30 consecutive days, either party may terminate the affected contract and we refund any sum paid for goods not yet despatched.

13. Governing law and complaints

These terms are governed by the law of England and Wales, subject to the non-exclusive jurisdiction of its courts; this does not affect mandatory consumer protection in your country of residence. Please email care@atelierbrim.co.uk first; we acknowledge complaints within 1 business day and respond within 5. Free independent help: Citizens Advice (citizensadvice.org.uk, 0808 223 1133), your local Trading Standards, the ICO (ico.org.uk, 0303 123 1113), the ASA (asa.org.uk) and the CMA (gov.uk/cma-cases). Under section 168 of the Data Protection Act 2018 you may also claim compensation for distress or damage from a data-protection breach.
